Brightwheel Teacher Appreciation Week Giveaway Terms & Conditions

1. Eligibility

The brightwheel Teacher Appreciation Week Giveaway (the “Giveaway”) is open to individuals who successfully complete the requirements in Section 3 during the Giveaway Period (“Entrant”). Entrants must be a legal resident of the 50 United States and the District of Columbia (“U.S.”) or Canada and be 18 years of age or older at time of entry. Entrant’s participation in the Promotion constitutes agreement to these Terms and Conditions (the “Rules”). Employees of the Sponsor, its affiliates, contractors, agencies, and anyone involved in the development or execution of this Giveaway, as well as their immediate family members (spouse, parent, child, sibling), are not eligible to enter. Void where prohibited, including Puerto Rico, U.S. territories, and overseas military bases. Entry into the Giveaway constitutes acceptance of these Rules—please review them before participating.

2. Giveaway Period

The Giveaway starts on Monday, May 5th, 2025 7:00 AM PDT and ends on Friday, May 9th, 2025 11:59 PM PDT (the “Giveaway Period”). Late entries will not be considered. All dates are subject to change. Sponsor’s server is the official clock for this Giveaway. All entries submitted during the Giveaway Period which are valid as of the drawing date will be eligible for the Giveaway.

3. Participation Requirements
To participate, entrants must:

  1. Like the official giveaway post.
  2. Follow brightwheel’s social media account on Instagram or Facebook.
  3. Comment on the giveaway post by providing:
  • The name of their program.
  • The city/state of the program.
  • A brief explanation of why their team is exceptional and deserving.

Only one entry per person/program is allowed.

4. Drawing / Odds

Sponsor’s decisions are based on their sole discretion and interpretation of these Rules, and are final and binding. Odds of winning depend on the total number of eligible entries received during the Giveaway Period.

5. Giveaway prize

One (1) giveaway winner will be randomly selected (the “Giveaway Winner”) on Monday, May 12, 2025 (the “Drawing Date”) and announced on Friday, May 16th, 2025, via brightwheel’s social media platform.The prize is a $150 USD Amazon gift card (the “Prize”). The total value of the prize is $150 USD. The prize is non-transferable and cannot be exchanged for cash or other products/services. Amazon is not a sponsor of this Giveaway, and no association or endorsement by Amazon is implied.

6. Contacting the Winner

The Giveaway Winner will be contacted directly through the social media platform used for entry. The Giveaway Winner must respond within 48 hours of notification to claim the Prize. If there is no response, an alternate winner will be selected.

7. Prize Restrictions

The Giveaway Winner must comply with all applicable laws and these Rules. Any taxes or expenses not expressly included with the Prize are the Giveaway Winner’s sole responsibility. Prizes are non-transferable and may not be substituted or redeemed for cash, except at Sponsor’s sole discretion.

8. Copyrights and Intellectual Property

By entering, you confirm that any comments or content you submit are your original work and don’t violate anyone else’s rights. You give Sponsor permission to use, share, and publish your submissions for promotional or other lawful purposes, in any media, without additional approval or payment.

9. Marketing Communications

By entering, you agree that Sponsor may use your contact information, including email address and phone number, to send you marketing communications, surveys, and promotional offers, subject to applicable privacy laws. You may opt out at any time.

10. Right to Cancel, Modify or Disqualify

Sponsor may cancel, suspend, or modify the Giveaway if it cannot run as planned due to technical issues, fraud, or other disruptions. Submissions with inappropriate, offensive, or irrelevant content will be disqualified. Sponsor may also disqualify any entrant for violating the rules, tampering, fraud, or unsportsmanlike conduct. Automated entries are not allowed and will be disqualified.

11. General Terms

All taxes and expenses not expressly covered by the Prize are the sole responsibility of the Giveaway Winner. Entrants agree to be bound by these Rules and the decisions of the Sponsor, which are final. Entrants release and hold harmless the Sponsor, its affiliates, agencies, and their respective officers, employees, and representatives (“Releasees”) from any and all liability, losses, or damages arising from participation or prize use, including personal injury, property damage, or rights of publicity/privacy.
By accepting the Prize, the Giveaway Winner consents to the use of their name, image, and likeness for promotional purposes by the Sponsor in any media worldwide without additional compensation, unless prohibited by law.
Releasees are not liable for: (a) technical errors of any kind, including malfunctions or unauthorized access; (b) lost, delayed, or corrupted entries; or (c) events that disrupt or corrupt the promotion.

12. Personal Data Protection

Participant information will be used solely for the administration of this giveaway and for marketing communications from brightwheel, and will not be shared with third parties for other purposes without consent.

14. Arbitration and Applicable Law

Except where prohibited, Entrants agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Giveaway, or any prize awarded, or the determination of the Giveaway Winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to these Rules of the American Arbitration Association, then effective, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway but in no event attorneys’ fees; and (3) under no circumstances will Entrant be permitted to obtain awards for and Entrant hereby waives all rights to claim punitive, indirect, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of Entrant and/or Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California, without regard for conflicts of law doctrine, and all proceedings shall take place in the State of California. Entrant waives any objection to the choice of forum on the grounds of inconvenient forum.

The Giveaway is organized and sponsored by DSSV, Inc. dba “brightwheel” (“Organizer” or “Sponsor”), located at 548 Market St, PMB 95237, San Francisco, CA 94104 and online at https://mybrightwheel.com/.

This Giveaway should not be published without written permission of the Sponsor.
